General Terms and Conditions Jialu National
These General Terms and Conditions (“GTC”) govern the contractual relationship between Jialu National (“jialu.ch”) and its customers (hereinafter referred to as “Customer”). The Customer unconditionally accepts the following provisions by completing the registration form and creating a user account (“jialu.ch account”) on the jialu.ch website or by sending an inquiry via the contact form. jialu.ch reserves the right to subsequently change or amend the GTC. These changes will only become part of the contract if the customer does not object within 14 days after becoming aware of them. The current version of the GTC is published on the website of jialu.ch.
1. scope
These General Terms and Conditions (“GTC”) govern the contractual relationship between Jialu National (“Jialu National”) and users of the platform operated by Jialu National under the URL jialu.ch (“Platform”). We offer you the use of the Platform on the condition that you agree to be bound by the following terms and conditions without modification. By using the Website, you signify your agreement to these terms.
For the use of the platform and the business relationship between Jialu National and the users, only the GTC in their currently available and valid version at the time of accessing the platform apply. We attach great importance to ensuring that our business relationships are based on transparent and fair conditions. Therefore, we ask you to read the following information carefully.
The GTC apply without restriction. Conditions that contradict, supplement or deviate from these GTC are only effective with our express written confirmation by Jialu National. We reserve the right to make changes to the TOS and will notify you of such changes in a timely manner. It is your responsibility to ensure that you acknowledge and accept the most current TOS.
2. Terms of Use

The company Jialu National offers a wide range of services on its platform, which may include specific terms of use in addition to the general terms and conditions. These special terms of use will be detailed on the relevant page on which each service is offered. In the event of any incompatibility between the special terms of use and the general terms and conditions, the special terms of use shall prevail.
3. Availability of the Platform

Jialu National acknowledges that it is not technically possible to guarantee 100% unrestricted availability of the Platform. Nevertheless, the Company makes every effort to keep the Platform continuously accessible. It should be noted that certain factors such as maintenance work, security measures, capacity limitations and external events beyond Jialu National’s control (e.g. disruptions in public communication networks or power outages) may lead to disruptions or temporary unavailability of the Platform.
4. Links to Third Party Websites

Jialu National’s Platform may contain links to external websites operated and maintained by third parties. Although Jialu National reviews the content of linked sites, it cannot be held responsible for the entire content of such external websites.
5. Liability

No liability is assumed by Jialu National and its employees and agents for any claims for damages, regardless of their legal basis. In particular, Jialu National shall not be liable for any indirect, consequential, lost profits or other damages to any person, property or pure assets of the Customer. However, it should be noted that there is a legal liability for gross negligence or unlawful intent.
6. Intellectual Property

Either Jialu National itself owns all rights to the Platform and its contents or they have been licensed to Jialu National by third parties. All related intater their content such as copyrights, trademark rights and other intellectual property rights belong exclusively to Jialu National or Jialu National’s licensors. Users may use such content only in the course of using the Platform and may not download, copy, reproduce, distribute, transmit, perform, sell, license or otherwise use such content without Jialu National’s prior written permission.
7. Contests

Through the Platform, Jialu National offers users the opportunity to participate in contests. Winners of these contests will be notified by Jialu National via the contact details provided (usually via email).
To ensure a fair competition, in online contests such as ratings, duels, quiz games and similar activities, Jialu National reserves the right to disqualify participants, adjust scores or terminate the contest early if there is evidence of tampering.
By registering for the contest, the user agrees that Jialu National is entitled to send him/her a newsletter on a regular basis to the email address provided. The newsletter can be unsubscribed at any time.
8. Privacy
Jialu National warrants that all data collected by Jialu National in the course of platform use will be treated in accordance with the Federal Unfair Competition Act and the Federal Data Protection Act. In addition to the TOS, Jialu National’s Privacy Policy regarding the collection and use of personal information applies.
9. Jialu National reserves the right to change the TOS and Jialu National’s offer

Jialu National reserves the right to make changes to these TOS and the Offer at any time and in its sole discretion.
10.Final Provisions

If any provision of these T&Cs is found to be invalid, the remaining provisions shall not be affected by such invalidity. The invalid provision will be replaced by a legally valid provision that comes closest to the original meaning and purpose. The same applies to any loopholes.
In the event of disputes, Swiss substantive law shall apply exclusively, to the exclusion of conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded.
For legal disputes, the exclusive place of jurisdiction is agreed to be the registered office of Jialu National, unless the law provides for other mandatory places of jurisdiction.
